General Purposes Sub-Committee: March 14th 1927

 

1078 On Minute No 1065 (Property - Sherlock Street) the General Manager reported that the question of obtaining a new lease had been held up pending arrangements being made between the Agents for the Gooch Estate and the City Surveyor with reference to the land which would ultimately be taken over for street widening purposes.

 

General Purposes Sub-Committee: May 9th 1927

 

1116 On Minute Nos 1065 and 1078 (property - Sherlock Street) the General Manager reported that the Public Works and Town Planning Committee had now agreed terms as to the land they would purchase for future street widening, and that it would now be possible to arrange for the granting of a new building Lease to the Bank.

 

Report of the Town Clerk: May 13th 1927

 

161, Sherlock Street.

 

I have to report I have completed the purchase from Mr George William Edwards at the price of £800, of the above leasehold premises.

I have, in addition to the purchase money, paid the Vendor's Solicitors' costs £16. 0. 6. and the stamp duty on the Assignment £8. 0. 0.

 

Bank Committee: May 16th 1927

 

The General Manager presented the following report with reference to the Sherlock Street property:

 

The Public Works & Town Planning Committee have now agreed with Messrs James & Lister Lea & Sons as to the amount they will pay for the land which will ultimately be taken for street widening purposes, and which forms part of the leasehold site purchased by the Bank.

 

The area of this land is approximately 88 square yards. The Bank agreed to pay a ground rent of £25 per annum in consideration of a new building lease being granted for 99 years, the present lease being surrendered.

 

Messrs James & Lister Lea & Sons are now prepared to reduce the ground rent pro rata in respect of the smaller area to be leased to the Bank, and the Public Works & Town Planning Committee are prepared to lease to the Bank at the same rate the area they are purchasing.

 

It is therefore recommended that the Bank Committee should agree to the adjustment of the ground rent on these lines; that the Town Clerk be instructed to act accordingly, and that the General Manager be instructed to obtain tenders for the demolition of the existing buildings according to the plans prepared by the City Surveyor, which have already been approved by the Bank Committee.

 

2683   RESOLVED:- That the adjustment of the ground rent in respect of 161, Sherlock Street, on the lines recommended in the forgoing report be approved and that the Town Clerk be instructed to enter into the new lease of the premises accordingly, affixing the Corporate Seal to the necessary document.

 

2684   RESOLVED:- That the General Manager be instructed to obtain tenders for the demolition of the existing buildings and the erection of new buildings at 161, Sherlock Street, in accordance with the plans prepared by the City Surveyor and already approved.

 

Bank Committee: June 20th 1927

 

2709  On Minutes Nos 2552 and 2683 (Lease of 161 Sherlock Street) the Town Clerk explained that the lease in course of preparation was in respect of the property taken over by the Public Works Department in addition to the portion acquired by the Bank. Completion of the lease had been delayed owing to a question having arisen with the Vendor's solicitors in respect of costs and the draft lease had been returned to them by the Town Clerk amended to meet the Corporation's requirements.

 

The General Manager stated also that the agents for the Gooch Estates had not as yet given their approval to the plan of the proposed new building and he had asked the City Surveyor to obtain this approval.

 

General Purposes Sub-Committee: July 11th 1927

 

Minute Nos 1065 and 1078 (property - Sherlock Street) the Sub-Committee were informed that a draft Building Lease had been submitted by the Solicitors to the Gooch Estate containing certain covenants which the Town Clerk had considered it desirable to amend or delete in returning the draft. The Solicitors had, however, reinserted the covenants in question, which involved important questions such as right of light and air, supports to adjoining premises, the date of the commencement of the Lease, the cost of the building to be erected by the Bank, and the professional charges to be paid to the Lessor's Solicitors and Surveyors. After consideration, it was:

 

1143   RESOLVED:- That the matter be referred to the Chairman and the Chairman of the General Committee, with the General Manager and Mr Frank Wilde, to confer thereon with the Town Clerk and the City Surveyor as to the best course of action to take in the matter.

 

Bank Committee: July 18th 1927

 

On Minutes Nos 2552 and 2683 (Property, 161 Sherlock Street) in view of circumstances which had arisen with regard to this property and which had been discussed at a Conference between  the Chairman, the Town Clerk, the City Surveyor and the General Manager on Friday last, it was:

2746   RESOLVED:- That a special meeting of the General Purposes Sub-Committee be held, with authority to take such action as they may consider desirable with regard to the property in question.

 

General Purposes Sub-Committee: October 10th 1927

 

1158 On Minutes Nos 1065/1078/1143 (Property in Sherlock Street) the Sub-Committee were informed that completion was held up pending the demolition of the dangerous wall adjoining, which the Magistrates had ordered should come down. The Minutes were continued.

 

Special Bank Committee: October 31st 1927

 

The City Surveyor informed the Committee that an order had been made by the Magistrates in respect of the wall adjoining the Bank premises in Sherlock Street and the demolition of existing building on the Bank site and the erection of new buildings could now be proceeded with. He submitted the plan already passed by the Committee and estimated the cost of the work involved  to be £3,821.

 

2824   RESOLVED:- That the General Manager be instructed to invite tenders in the usual way for the carrying out of the work.

On Minute No 1065 (Proposed alterations to property in Sherlock Street) it was:

1229  RESOLVED:- That the General Committee be recommended to accept the tender of Mr Francis H Smith at the sum of £3,850, the work to be carried out within a period of seven months as indicated in the tender.

 

Report of the Town Clerk: February 18th 1928

 

I have to report I have completed the Surrender of the Lease of the above premises which were recently acquired by your Committee from George William Edwards, and also the granting of a new Lease of the back portion of the land containing 154 sq. yds. from Sir Thomas Vere Sherlock Gooch. The Lease is for 99 years from the 24th June 1927 at the yearly rent of £16 and is subject to a covenant that the Corporation shall erect within two years from the 1st day of July 1927 premises to the value of £2,000 at least. The Lease contains the covenants and conditions usual in Leases of this nature.

 

Your Committee will recollect that the front portion of the land comprised in the purchase from G W Edwards, containing 88 sq. yds. has been purchased by the Public Works & Town Planning Committee for future road widening purposes, but that your Committee will have permission to erect a temporary structure upon this land pending the road widening taking place, your Committee paying to the Public Works Department the difference between the ground rent of £16 payable to the Gooch Estate and the total ground rent of £25 which would have been chargeable upon the whole area of the land.

 

I have paid your Committee's share of the Solicitors' costs, Surveyors' charges and stamp duty in relation to the transaction, amounting to £30. 13. 4.

 

Finance Sub-Committee: March 12th 1928

 

The Sub-Committee were informed that in connection with the contract for Sherlock Street alterations, the question had been raised as to the reduction in wages which took effect just after the contract of Mr F H Smith had been accepted. Mr Smith stated he had allowed for such reduction in his tender and the City Surveyor was of opinion that this was so.

 

193     RESOLVED:- That the assurance of Mr F H Smith be accepted and that the contract be entered into as previously directed.

 

Report of the Town Clerk: May 18th 1928

 

I have to report that the following Contract is now duly completed:

General Purposes Sub-Committee: December 10th 1928

 

The General Manager reported that an infringement of right of light had occurred in relation to premises adjoining the Sherlock Street branch, and it was:

 

1335   RESOLVED:- That the matter be referred to the Town Clerk and General Manager with authority to take such action in the matter as they may consider expedient.

 

On Minute No 1320, the General Manager presented the following report with regard to the available use of land and buildings purchased for branch bank purposes:

Bank Committee: December 17th 1928

 

The General Manager reported that the Sherlock Street premises were nearing completion, and it was:

 

3284   RESOLVED:- That the Lord Mayor be invited to formally open the premises, and that the Chairman be requested to fix a suitable date convenient to the Lord Mayor.

 

The General Manager read a letter from a Miss Doody complaining of loss sustained by her as a result of the hoarding erected in connection with the Sherlock Street building operations, and it was:

 

3285  RESOLVED:- That the matter be referred to the Chairman and Chairman of the Finance Sub-Committee with the General Manager for consideration and report.

 

Report of the General Manager: January 8th 1929

 

Claim for Compensation by the Tenant of 159 Sherlock Street.

 

The Chairman and the General Manager waited for an hour on December 27th, to interview Miss Doody, the tenant of the above premises, but she failed to put in an appearance. On enquiry being made as to her failure to attend, she explained that she had not received the letter until after the 27th ultimo, and that she understood the appointment was for a week later.

 

The Chairman again attended at the Bank on the 2nd January, and interviewed Miss Doody in company with the General Manager.

 

Miss Doody stated her case, but despite the fact that every endeavour was made to find out what actual loss she has sustained, both the Chairman and the General Manager were unable to obtain anything of a confirmatory nature, and in the end Miss Doody was told that if she would put her statement and claim in writing in a clear manner it should be sent to the Town Clerk, and that if she was able to prove to the Town Clerk's satisfaction that she had actually suffered the loss she claimed, then the Chairman would undertake to bring the whole matter before the Bank Committee for their decision.

 

Miss Doody has since sent in her statement in the form of a letter, which has been sent on to the Town Clerk.

 

Report of the Town Clerk: January 15th 1929

 

re Sherlock Street premises.

 

I was instructed to take such action as I might consider expedient in connection with the claim by Dr Trench for alleged obstruction of light to the rear of his premises.

 

Dr Trench consulted his Solicitors in connection with the claim and I denied the Corporation's liability in the matter.

 

As no further steps have been taken by Dr Trench I ask for the Minute to be discharged.
 

General Purposes Sub-Committee: January 21st 1929

 

Claim for Compensation - Sherlock Street.

 

The tenant of 159 Sherlock Street, whose premises adjoin the Bank recently opened, has put forward a claim for compensation for what is described as loss in business due to the erection of a hoarding around the Bank, and the progress of the work of erecting the Bank.

 

The tenant (Miss Doody) has been interviewed by the Chairman and General Manager, who were unable to obtain any evidence whatever that she had suffered any loss consequent on the building operations. Miss Doody was, however, told that if she was able to prove to the Town Clerk's satisfaction that she had actually suffered loss, the whole matter should be brought before the Bank Committee for their decision. Miss Doody in due course forwarded a letter, which has been considered by the Town Clerk, but no satisfactory evidence of loss is forthcoming and as the tenant is unable to produce any books it is impossible to corroborate her statement. The Town Clerk's view is that the tenant has no legal claim against the Corporation merely because of the putting up of a hoarding in front of their premises with a view to the reconstruction thereof.

 

The matter has been carefully considered but as it does not appear that Miss Doody has any claim against the Corporation, your Sub-Committee are not disposed to recommend an ex gratia payment being made to her.

 

It should be explained that the Contractor, at his own cost has repainted the shop front of No 159 Sherlock Street, although he was not under any obligation to do so.

 

General Purposes Sub-Committee: February 11th 1929

 

The Sub-Committee were informed that Miss Doody, whose claim for alleged damage arising out of the building operations for the Bank premises in Sherlock Street had been disallowed by the Bank Committee, had again pressed for her claim to be further considered. The Sub-Committee, having regard to the fact that no fresh evidence was forthcoming in support of her claim, decided to take no action in the matter.
