Leasing of Flat - Sherlock Street Property.
Arrangements have now been made for the
leasing of this flat to Mr J A Desormes for a period of three years from 25th March 1929, at an annual rental of £50, the tenant being
responsible for rates, taxes and interior repairs.
General Purposes Sub-Committee: October 14th 1929
The General Manager reported that his attention had been drawn to properties 112, Balsall Heath Road, 438 Fox Hollies Road and the corner of Bromsgrove Street and Dean Street, which properties he was informed were available for sale.
1439 RESOLVED:- That as the requirements
of the Bank in these areas have been met, no action be taken in the matter.
Finance Sub-Committee: October 13th 1930
The General Manager reported that the tenant of the Sherlock Street flat was in arrear with his rent for two quarters. The question of ejection had been considered, but it was pointed out that the tenant, who had formerly been engaged in the Orchestra of The Empire, was at present out of employment, although he had secured an engagement for the pantomime season at Exeter. In the meantime, he had promised to pay £1 per week, undertaking to discharge the arrears upon obtaining employment.
467 RESOLVED:-
That the above-mentioned offer of the tenant of the Sherlock Street flat be accepted and the matter left with the General Manager.

On Minute No 467 (arrears of rent, Sherlock Street flat) the General Manager reported that the tenant had carried out his promise to pay £1. 0. 0. per week but had not made any additional payments as he had promised to do upon taking over his engagement as leader of the orchestra at the Exeter pantomime, in which for the past fortnight he had taken part.
497 RESOLVED:- That the General Manager be directed to press the tenant for a substantial payment in respect of the arrears of rent amounting
to £26. 18. 0d. in accordance with his undertaking.

507 On Minutes 467 and 497 (arrears of rent - Sherlock Street Flat), the General Manager reported the payments which had been made towards
the arrears of rent. Further consideration of the matter was deferred.

On Minutes Nos 467 and 507 the General Manager reported that the tenant of the Sherlock Street Flat, who had reduced the arrears to £8. 8. 0., had now returned to Birmingham and had asked to be allowed to make regular payments of £2 per week until the whole of the arrears were discharged.
519 RESOLVED:- That the offer of the tenant of the Sherlock Street Flat to make regular
payments of £2 per week until the arrears are discharged be accepted.

report of the above-mentioned Sub-Committee was presented:
Damage to Branch Bank Premises - 161 Sherlock Street
(Sub-Committee
Minute No 1710).
The following report of the Town Clerk has been received on this matter:
"In accordance with the resolution
of your Committee under the above-numbered Minute, I have investigated the question of responsibility for the repair of the damage
caused to your Sherlock Street Branch premises by the falling of masonry from the war damaged adjoining property, No 163 Sherlock
Street. My conclusions are that the Gooch Estate must be held responsible for this damage, and that your Committee should look to
them for re-imbursement of the costs incurred for making good the Bank premises. The War Damage Commission have agreed to meet the
cost of rendering the exposed wall of the Bank premises with a protective coat, this work having been made necessary by the complete
demolition of the gable wall at No 163 and because such costs are properly ancillary to the War Damage Claim registered in regard
to that property. I do not think any further claim can be made upon the Commission in the matter. The damage to the Branch Bank premises
is in a different category. It is storm damage, the consequences of which could and should have been foreseen by the Gooch Estate,
and the position safeguarded. The first works of demolition at the site of No 163 were carried out early in 1944 by Ministry
of Works, and not by the City Surveyor's Department, and since then there has obviously been ample opportunity for the Gooch Estate
to have discovered that the condition of the remaining gable wall structure had deteriorated, and was unsafe.
Accordingly, I
have notified Messrs James and Lister Lee and Sons, the Agents for the Gooch Estate, as to these conclusions, and would suggest that
your Committee should now instruct me to take all requisite steps to enforce your Committee's claim in this regard."
Claim for
damage - Sherlock Street Branch.
8339 RESOLVED:- That the Town Clerk be authorised to take all requisite steps to
enforce the claim of the Bank against the Gooch Estate in respect of redress for damage to Branch Bank premises, No 161 Sherlock Street,
as indicated in the report.
In April 1947 a report was submitted to the Committee that during a gale on Sunday evening, the 16th
March 1947, the gable and which remained of the adjoining demolished property, No 163 Sherlock Street, was blown on to the flat roof
over the Sherlock Street Branch, carrying with it the Bank's own parapet. In its fall, it broke through and completely destroyed one
of the lantern lights (6' x 8') on the flat roof, together with the laylight below, causing also considerable damage to the plaster
ceiling, and to 12' of counter and certain counter fittings.
Mr Surman negotiated with the War Damage Commission, who agreed
to pay the cost incurred in making good and rendering waterproof the surface of the wall of the Bank premises exposed by the collapse
of the wall above referred to. They did not, however, consider the other repairs to be consequential War damage.
Certain urgent
external and internal repairs have already been executed.
The Town Clerk reported to the Committee in October last that, in his
opinion, the Gooch Esttate, to whom the adjoining site in question belongs, must be held responsible for the repair of the damage,
other than that to be met by the War Damage Commission. A further report was submitted by the Town Clerk in May last, that Counsel
had advised that the Corporation were entitled to succeed on any proceedings which may be brought against the Gooch Estates Ltd in
respect of these repairs. While waiting for the completion of the work and the Architect's final account, the Town Clerk proposed
to continue his efforts to establish the Bank Committee's claim.
In February last I reported to the Committee that the approximate
amount of the claim against the War Damage Commission as given by Mr Surman was as follows:

The
Bank Committee, at their meeting on October 20th, instructed the Town Clerk to take all requisite steps to enforce the claims of the
Bank.
The Town Clerk is of the opinion that proceeding with the internal work would not prejudice and claim against the Gooch
Estate. In view of the present unsatisfactory condition of the Banking Hall, the Architect has been instructed to have the outstanding
internal work executed and to notify the Gooch Estate accordingly.
The Committee will remember that a report was submitted at
their meeting on the 1st December, that No 159, Sherlock Street, the property on the other side of the Branch, is to be demolished
under a Contract led by the Public Works Department, and the War Damage Commission have agreed to meet the cost of making good any
part of the Bank premises affected or disturbed during the demolition.
Mr Surman, who is watching the Bank's interest, informed
the General Manager on the 19th January, that the Contractors had already begun the demolition and that he would advise him of further
developments as necessary.
