Bank Committee: February 18th 1929

 

The Committee were informed that Messrs Taylor and Taylor, Auctioneers and Estate Agents of Smethwick, acting for the owner of property in Willow Avenue (Mr Brookes) adjoining the Bearwood site, had made application to rent any land not required by the Bank, for the erection of a garage and other purposes.

 

3353   RESOLVED:- That the matter be referred to the General Purposes Sub-Committee, with instructions to obtain the views of the Tramway and Omnibus Committee thereon, and to consider and report their recommendation.

 

General Purposes Sub-Committee: March 11th 1929

 

The Sub-Committee proceeded to consider the question of dealing with the surplus land at Bearwood, which had been referred to them by the General Committee in connection with an application received from Messrs Taylor & Taylor, Auctioneers, to purchase the land. The Sub-Committee were informed that an intimation had now been received from the City's Surveyor to the effect that the Watch Committee were contemplating the possibility of securing the land in question for purposes of a Police Station. In view of the terms of the Arbitrator's Award in respect of the land utilised by the Bank and Tramways Committees, the General Manager stated that he had written to the Town Clerk to ascertain his views in regard to the risk involved by the Watch Committee in taking over the surplus land, and the matter was at the present time receiving the Town Clerk's consideration.

 

After consideration, the Sub-Committee were of opinion that so far as the Bank was concerned there would be no objection to the land being transferred to the Watch Committee on the understanding that they were prepared to take the risk which attaches to this land on account  of restrictive covenants, and that the transfer should take place on the basis of the original purchase price and expenses, in the ratio that the area transferred bears to the total area, and also subject to one-third of the costs and expenses incurred in respect of the arbitration proceedings which had already taken place. It was accordingly:

 

1375   RESOLVED:- That the General Manager be instructed to convey the views of this Sub-Committee to the Chief Constable, and report in due course the result of his interview.

 

Bank Committee: March 18th 1929

 

3363  The following report of the General Purposes Sub-Committee was presented:

 

Surplus Land, Bearwood Site.

 

With reference to the application from Messrs Taylor & Taylor, Auctioneers, to purchase the surplus land at Bearwood (which application was referred to your Sub-Committee for consideration), an intimation has now been received from the City Surveyor to the effect that the Watch Committee were contemplating the possibility of securing this surplus land for purposes of a Police Station.

 

Your Sub-Committee have no objection to raise to the land being transferred to the Watch Committee if they desire to proceed with their scheme, and to take the risk which attaches to this land on account of restrictive covenants, the transfer to be arranged on the basis of the original purchase price and expenses, calculated in the proportion that the area of land so transferred bears to the total area, and subject to one-third of the costs and expenses incurred in the arbitration proceedings which have already taken place.

 

They have accordingly instructed the General Manager to confer with the Chief Constable on the whole matter and to present a further report to your Sub-Committee.

 

With reference to the paragraph in the foregoing report relating to surplus land available on the site at Bearwood, the General Manager stated that Messrs Taylor and Taylor, Auctioneers, had requested to be informed whether their application for the acquisition of this land could be acceded to by the Bank Committee. On consideration of the matter the Committee were informed that the Watch Committee had before them the question of taking over the surplus land referred to, and some months ago they instructed the City Surveyor to prepare plans for the erection of a police station. The Town Clerk intimated that it was proposed to bring the matter before the Watch Committee at a meeting to be held tomorrow when the position with regard to the arbitrator's award would be pointed out to them.

 

3366  RESOLVED:- That further consideration of the matter be deferred pending the decision of the Watch Committee.

 

General Purposes Sub-Committee: April 15th 1929

 

Surplus land at Bearwood.

 

The Watch Committee have now intimated that, having regard to the circumstances in connection with the restricting covenants on the land at Bearwood, it is not their intention to proceed further with the proposal for the acquisition of the surplus land from the Bank Committee.

 

Your Sub-Committee have accordingly authorised the General Manager to give consideration to the application made by the adjoining owner to acquire the land, and to report thereon in due course.

 

Finance Sub-Committee: May 13th 1929

 

333     The General Manager reported that on the authority of the Chairman of the General Committee and the Chairman of this Committee respectively tenders for fitting out Bearwood branch had been accepted as follows:

R Hunt: £214. 10.  0d.

 

Bank Committee: May 13th 1929

The General Manager reported that the Springfield and Bearwood Branches were nearing completion and it was:

 

1407   RESOLVED:- That the General Manager be directed to make arrangements for the opening of the Springfield Branch on the 29th June and to endeavour to arrange for the Bearwood Branch to be opened on or about the 31st August.

 

Bank Committee: May 15th 1929

 

3423   The following report of the General Purposes Sub-Committee was presented:

 

Surplus Land at Willow Avenue, Edgbaston.

 

Your Sub-Committee report that Mr Roland Fletcher, who owns the house (17, Willow Avenue) adjoining this surplus land, has made application for a strip of land from three to six yards in width and running the full depth of the site, to be sold to him for the purpose of improving his garden, as some protection to the rear windows of his house, and erection of a garage, etc, on payment of a reasonable price for the land. Mr Fletcher would take down and re-erect his existing boundary fence to the new line.

 

Your Sub-Committee propose to inspect the land in question immediately prior to the meeting of the Committee, with a view to making some recommendation in the matter.

 

With reference to the paragraph of the foregoing report as to the surplus land at Willow Avenue, Edgbaston, the Committee were informed that members of the General Purposes Sub-Committee had that morning visited the site with Mr Frank Wilde. They were of opinion that it would be undesirable to grant the application of Mr Fletcher, and that the surplus land should be sold as a whole.

 

After consideration, it was:

 

3434   RESOLVED:- That the General Manager be instructed to ascertain in accordance with General Instruction No 31, whether any other Committee of the Corporation is desirous of acquiring the land in question; and that in the event of there being no such application, Mr Wilde be instructed to dispose of the land by auction, or private treaty at a price of not less than 10s. 0d. per square yard.

 

Report to the City Council: June 4th 1929

 

In connection with the joint action by the Bank and Tramway and Omnibus Committees in connection with the erection of the Bank and for improved turning arrangements for omnibuses in Sandon Road, objections were lodged by a number of residents on the Estate, with the result that the matter was submitted to arbitration under the Law of Property Act, 1925. The Arbitrator awarded to 7 objectors the total sum of £590, the claims of the remaining 129 objectors being dismissed.

 

General Purposes Sub-Committee: June 10th 1929

The Sub-Committee were informed that the Corporation Departments had been notified of the surplus land available at Bearwood, but no request had yet been received for the transfer of such land. Several private enquiries had also been made regarding the land.

 

Bank Committee: October 21st 1929

 

3519  The following report of the General Purposes Sub-Committee was presented:

 

Surplus Land in Willow Avenue, Bearwood.

 

Your Sub-Committee report that the surplus land in Willow Avenue has been sold to Mr Donald Rogers for the sum of £365, which price was in accordance with Mr Wilde's valuation. Authority to enter into the contract for sale was given to the Town Clerk by your Chairman, and it is recommended that the action taken be confirmed, and that the Town Clerk instructed to seal the necessary Deed of Conveyance.

 

Sale of Premises No 177, Sandon Road, Bearwood.

 

The premises No 177, Sandon Road, Bearwood, formerly occupied by the Bank, have been sold to Mr Edwin Charles Andrews of 2 Barnsley Road, Edgbaston, for the sum of £1,000 (plus £20 for the wooden erection at the rear of the premises), which was the valuation placed upon the property by Mr Wilde. Your Chairman authorised the Town Clerk to enter into the contract for sale and your Sub-Committee recommend that the action taken be confirmed, and the Town Clerk instructed to seal the necessary Conveyance.

 

3521   RESOLVED:- That the sale of the surplus land in Willow Avenue to Mr Donald Rogers for the sum of £365 be approved and Minute No 3424 be discharged; that the action of the Chairman in authorising the Town Clerk to enter into the Contract for sale be confirmed; and that the Town Clerk be instructed to affix the Corporate Seal to the Deed of Conveyance.

 

3522  RESOLVED:- That the sale of the premises, No 177, Sandon Road, Bearwood, to Mr Edwin Andrews for the sum of £1,000 be approved; that the action of the Chairman in authorising the Town Clerk to enter into the Contract for Sale be confirmed, and that the Town Clerk be instructed to affix the Corporate Seal to the Deed of Conveyance.

 

3534   RESOLVED:- That the lease of the flat situate on the first floor at the Bearwood Branch to Mr Leonard John Bradfield at an annual rental of £60 for 3 years from the 28th September 1929, plus rates, outgoings and internal repairs, be approved, and that the Town Clerk be instructed to enter into the necessary Agreement, affixing the Corporate Seal thereto.

 

Report of the Town Clerk: February 14th 1930

 

I have to report that I have completed the sale of the piece of surplus land adjoining the bank premises in Willow Avenue, containing 730 square yards, to Mr Donald John Rogers, for the sum of £365.

 

General Purposes Sub-Committee: May 12th 1930

The General Manager reported that the Tramways Department had asked to be allowed to place a Bundy clock on the enclosed portion of the land adjoining the entrance of the Bank at Bearwood.

 

1542  RESOLVED:- That the General Manager be directed to confer with the General Manager of the Tramways Department upon the matter, reporting thereon to the next meeting of this Sub-Committee.

 

General Purposes Sub-Committee: June 2nd 1930

 

On Minute No 1542, the General Manager reported that after conference with the General Manager of the Tramway and Omnibus Department, arrangements had been made to place the "Bundy" clock in a suitable position on the land adjoining the Bearwood Branch.

 

1552   RESOLVED:- That Minute No 1542 be discharged.

 

General Purposes Sub-Committee: May 11th 1931

 

1666   The General Manager reported that the Gas Department had drawn attention to the fact that portions of the gas mains were laid underneath what is now the forecourt of the Bearwood Branch, the improvement line being altered after the laying of the mains. Permission was given by the Public Works Department for dwarf forecourt walls to be built in their present position. The Gas Department point out that the arrangement is not satisfactory and that the proper course to adopt would be to take up the main and re-lay the same under the footpath at an estimated cost of from £45 to £50, a course they intend to follow in respect of the spare land fronting Willow Avenue which the Bank sold by public auction.

 

Mr Bevan of the Public Works Department approached the General Manager on this matter and was told that every facility would be granted to the Gas Department for opening up and carrying out any work which it may be necessary to do in connection with the gas main, and would make no claim for interference or disturbance of the shrubs on the forecourt, but that the Bank could not give an indemnity with regard to the cost of any repairs to the main which may be due to the imposition of the walls thereon.

 

The Gas Department now ask for confirmation of the General Manager as to granting facilities for excavation, etc and for an indemnity with regard to the cost of repairing any damage occasioned by the imposition of the wall on the main, and state that if such indemnity is given they will allow the pipes to remain in their present position. The Gas Department further suggest that the position of the gas main should be indicated on the deed of conveyance of the property.

 

After consideration of the whole matter the Sub-Committee confirmed the promise of the General Manager as to facilities being given for opening up and carrying out any work which may be necessary, and also confirmed that no claim should be made for disturbance or interference of the shrubs on the ground, but directed the General Manager to inform the Gas Department that they are not prepared to give an indemnity for the cost of repairing any damage occasioned to the main by the imposition of the wall.

 

With regard to indicating on the deeds the position of the gas mains, the Sub-Committee raised no objections, although they considered it unnecessary, as the property is not likely to be disposed of.
