 Finance & General Purposes Sub-Committee: May 10th 1926

 

The Sub-Committee were informed that Mr Wilde advised that the rental of the dwelling accommodation at the Sparkbrook Branch (Nos 161 and 163, Stratford Road) should be £30, per annum, plus rates in each case, and the General Manager reported that he had agreed the terms with the two tenants that they should apply from the date the alterations taking place are completed.

 

142     RESOLVED:- That the General Manager's action in the matter be confirmed.

 

Report of the Finance & House Purchase Sub-Committee: May 15th 1926

 

Rental of Dwelling Accommodation - 161-3, Stratford Road.

 

The rental of the two tenancies at the Sparkbrook Branch have now been fixed in each case at £30, per annum plus rates, as and from the date when the alterations now taking place are completed.

2800 The following report of the Finance Sub-Committee was presented:

Sparkbrook Branch - Tenancy of 161a Stratford Road.

 

Your Sub-Committee report that Mrs Sankey, the former tenant of the dwelling accommodation at the above premises has now been accommodated in a Corporation house and Mr Scott has been given possession of 161a Stratford Road at the rental of £30 per annum. Your Sub-Committee recommend that the Town Clerk be instructed to enter into an agreement for an annual tenancy in the matter.

 

2805   RESOLVED:- That the Town Clerk be instructed to enter into an Agreement with Mr L Norman Scott for an annual tenancy by him of accommodation at 161a Stratford Road at a rental of £30 per annum plus rates, affixing the Corporate Seal to such Agreement.

 

Bank Committee: January 16th 1928

 

On Minute No 2805 (living accommodation, 161a Stratford Road) the Town Clerk presented the following report as to the completion of an agreement for tenancy with Mr L N Scott:

 

January 9th 1928

Minute No: 2805 - 161a Stratford Road.

I have to report that in accordance with the above Minute I have completed an Agreement for the tenancy of the flat at the above premises with Mr Leonard Norman Scott. The tenancy is a yearly one commencing on the 29th September last, at a rent of £30 payable quarterly. The Tenant is to pay the rent and keep the interior of the premises in repair.

 

2919   RESOLVED:- That Minute No 2805 be discharged.

 

General Purposes Sub-Committee: December 10th 1928

 

On Minute No 1320, the General Manager presented the following report with regard to the available use of land and buildings purchased for branch bank purposes:

 

General Purposes Sub-Committee: February 11th 1929

 

The following report of the Town Clerk with reference to the question of outstanding rent in respect of premises No 161-163, Stratford Road was received:

 

161 and 163 Stratford Road.

I beg to remind your Committee that when the above freehold premises were purchased for your Committee in May 1921, your Committee had already been in occupation of a portion of the premises numbered 163, under an Agreement of Tenancy dated the 7th March 1920 entered into with Berkeley Wright, at a rental of £31 per annum. This rent was paid to Wright up to the 31st May 1920 but no payment was made after that date as Wright was serving a term of imprisonment, his wife and family were removed to one of the Poor Law Institutions, and the portion of the house occupied by Wright and his family was from then void up to the time of the purchase by your Committee.

 

Wright held the premises at a rental of £40 per annum as head tenant from the Vendors who sold the premises to the Corporation.

 

As Wright was very much in arrear with his rent the Vendor's Solicitors asked that the Corporation should pay over to their clients any rent which might have accrued due from the Corporation to Wright. I informed them that I could not advise your Committee to do this without evidence that Wright's tenancy of the premises had actually terminated on the date when they left the premises, and without authority either direct from Wright or by judgement of the Court to pay such rent over to their clients. They took no steps to obtain any such authority.

 

I have now received a letter from Messrs Shakespeare & Vernon, the Vendor's Solicitors, again raising the matter, and they point out that it will be 8 years in May since the purchase was completed and suggest that the money should now be handed over to them. I have to point out that the rent in question in any case could not now be recovered by Wright from the Corporation as the Agreement between him and the Corporation was not by deed, and more than six years have expired since it accrued due.

 

Your Committee will probably not wish to take advantage of the circumstances to relieve them from paying rent from the 31st May 1920 until the date fixed by the Contract for completion, namely the 30th January 1921, and if that is the case there appears to be no reason why the Corporation should not now comply with the request made on behalf of the Vendors.

 

I shall be glad to receive your instructions.

 

1356  RESOLVED:- That the General Committee be recommended to authorise the General Manager to meet the claim for the payment of rent outstanding in respect of No 163, Stratford Road, for the period from 31st May, 1920 up to the 30th January, 1921 to be paid to the Vendors of the property.

 

Bank Committee: February 18th 1929

 

3334   The following report of the General Purposes Sub-Committee was received:

 

Payment of Rent at Sparkbrook Branch.

Prior to the purchase of the property Nos 161 and 163 Stratford Road in 1921, the Bank were in occupation of the front portion of No 163 Stratford Road as sub-tenants of Mr Berkeley Wright, and rent at the rate of £2. 11. 8d. per month was paid to him up to the 31st May 1920. Wright was imprisoned for some offence, and from the 31st May 1920 no further rent was paid.

 

The Solicitors for the Vendors have, at different times, made requests that the rent should be paid to them, but no step has been taken in the matter up to the moment. A further claim has now been made by the Solicitors, and a full report on the circumstances has been furnished by the Town Clerk and considered by your Sub-Committee.

 

Having regard to the time which has elapsed, and to the facts of the case, your Sub-Committee are of opinion that the Bank should meet the claim of the Vendor's Solicitors, and pay the rent from the 31st May 1920 up to the 30th January 1921, and they recommend accordingly.

 

3336  RESOLVED:- That the General Manager be instructed to meet the claim for rent outstanding in respect of premises No 161 and 163 Stratford Road, for the period from the 31st May, 1920 to the 30th January, 1921 to be paid to the Vendors of the property.
